Article 2: PURPOSE
The purpose of these Terms and Conditions of Sale is to set out the rights and obligations of both Parties, exclusively due to the relationships they initiate on the Internet, with respect to any and all online sales of products offered on the Site. These terms apply to non-traders on an exclusive basis.
The sale is reserved for major or minor customers/individuals with parental agreement.
Article 3: VALIDATION OF ORDERS & ELECTRONIC SIGNATURE
Any order taken in respect of a product appearing in the online shop of the site www.lovedelles.com assumes the consultation as well as the prior acceptance of the present general conditions of sales.
Validation of the order implies full acceptance of these terms.
The items ordered remain the property of the sellers until full payment of the whole order by the buyer.
Article 4: PRICES
All prices are in Euros all taxes included except for the participation in the shipping costs (see the paragraph related to delivery costs and delays)
The products will be invoiced on the basis of the rates in effect at the time of registration of the orders. The products remain the property of Lovedelles until full payment is acknowledged by the seller’s bank/records. The price is payable in full and in one installment.
The seller reserves the right to change prices at any time and without prior notification.
Article 5: ORDER & AVAILABILITY OF PRODUCTS
Customers can order on the internet via the website www.lovedelles.com
lovedelles reserves the right to cancel or decline any order from a customer with whom there is a dispute related to the payment of a previous order or which would represent any form of risk to the sellers.
Each order constitutes agreement of (terms and conditions) prices and description of products available for sale. The seller is committed to honoring all orders received on the website only within the limit of stock availability. In case of non-availability of one or more product(s), the customer will be informed by the status “out of stock” showing on the website, the order will therefore not be validated.
Article 6: PAYMENT & SECURITY
Payment of purchases is made upon customer choices: either
- by bank transfer, bank cards or credit cards
Secured card payment:
The payment is made via our secured financial partner website sofort. This implies that none of your financial information will transit through our website. Payment by credit card is therefore completely secure. Your order will be registered as soon as the payment is validated by the banking services. You pay online with full confidence by entering the number, the expiry date and the security code located at the back of your card where appropriate.
Your credit card details are encrypted using Secure Socket Layer (SSL) and never appear through the network. Payment is made directly to the bank. The seller has no access to these details, and does not keep them on its servers, reason you will need to proceed as such each time you will place an order.
'Love of d' Elles” does not save any of the Customer banking details.
FIGHT AGAINST FRAUD : Control of Rules & Regulations:
Lovedelles reserves the right to check the validity of the payment, before the order is dispatched, by any means that the seller deems necessary (in particular the request for identity documents, proof of address etc.)
Default of Payment:
Lovedelles reserves the right to refuse a delivery or to honor an order from a customer who would have not paid in full a previous order or with which a payment dispute would be still on hold. In case of fraud or suspicion of fraud, the seller reserves the right to write any member off without any notification or compensation.
Article 7: DELIVERY & TIME
Lovedelles performs deliveries all over the world.
In the event of an incorrect entry, especially with an incorrect or incomplete delivery address, the seller cannot be held responsible for the consequences in terms of delay or lack of delivery. The customer will have to communicate a valid e-mail address, failing which the seller Lovedelles cannot be held responsible for its resulting consequences. All expenses related to the redirection of the products due to an error of seizure of the customer will be at the exclusive charge of the said customer.
Lovedelles dispatches orders in 24h from Monday to Friday. Orders placed on a Saturday, Sunday or public holiday will be processed on the next working day.
Shipping by DHL express
Deliveries to the DOM-TOM:
Deliveries in Martinique, Guadeloupe and Reunion are made by DHL Express. The price of such a delivery is 12.50 € , not including the customs fees. The general delivery time is 1 to 2 working days. Your package will be delivered against signature.
Delivery DHL Express America:
Deliveries to the United States, Canada and Mexico are made through DHL Express. The delay is 24 / 48h (working days) depending on custom clearance and costs 13 € (excluding custom charges). Your package will be handed-over only against signature and will not be left in your mailbox or at a neighbor’s.
Delivery DHL Express Asia and Africa:
For Asia and Africa, DHL Express offers a delivery fee of 14.90 € (excluding custom charges) within 1 to 3 working days, depending on custom clearance.
Delivery in Europe:
For Belgium is free; Germany, France, the United Kingdom, Italy, Luxembourg and the Netherlands, DHL Express Europe 1 delivers door to door and against signature within 24 hours, for a price From 9.99 €.
Delivery in Spain:
DHL Express delivers in Spain within 24 / 48h, against your signature for a price of 9.99 €.
For Austria, Denmark, Finland, Greece, Ireland, Portugal and Sweden DHL Express Europe 2 delivers to your home, against your signature within 24h, for a price of 10.99 €.
For Eastern Europe and Russia, DHL delivers to your home within 1 to 2 working days, against your signature for a price of 22 €.
For Switzerland and the rest of Europe, DHL Express delivers within 24h against your signature, for a price of 12.99 € (customs fees not included).
Delivery Fedex Express World:
For all the rest of the world, Fedex Express offers a delivery within 1 to 4 working days to your address, against your signature for 24.99 € (customs fees not included).
In case of a batch shipment of several items in a same order, the delivery costs for one item remains as mentioned above, the delivery of the additional items of that same order is free of charge.
The carriage time frames indicated above are to be taken into account on the basis of a door-to-door shipment. We shall not be held responsible for any delay of the carrier, especially due to weather conditions, strikes or any circumstance outside one’s control.
All the products leave our premises in perfect condition. The customer must notify the carrier (or the postman) of any degradation (holes, traces of shocks, etc.) on the parcel and, if necessary, decline the parcel.
The exchange of any product declared, a posteriori, damaged during transport, without any reserve being issued on receipt of the parcel, cannot be accepted.
The customer must report, within 24h, any incident of delivery to our customer service department by email to email@example.com
Article 8: EXCHANGE, RETURN, RIGHT OF RENUNCIATION
According to the law, the consumer has fourteen (14) working days from the day after the day of delivery to cancel his purchase. For any return request, please follow the steps mentioned in the Exchange section, this procedure involves the return of the goods in their original packaging, undamaged, accompanied by all their accessories as well as the original invoice. The incomplete order, damaged or soiled by the customer, will not be reimbursed. The returned products must not have been unpacked, used in any way. The customer agrees to return the goods by traced and secured mail to the head office of Operation of the company

Within 30 days of the return, the seller undertakes to refund the payment, with the exception of the shipping costs.
The exchange is valid only as far as sizes .
The postage costs of return and a possible new shipment will be at the customer’s expenses. From the moment the exchange process is initiated, the Customer has 48 hours to hand the parcel to return over either to the Post Office or to the place specified in the mail sent in the exchange procedure.
The exchange does not imply the reservation of any item. If, at the time of receipt of the return package, the item requested in exchange is no longer available, the customer will not be able to claim it. Lovedelles will then offer the customer another equivalent item or a refund.
Only new, clean items, including their labels always sewed, and in perfect state of resale will be taken back in their original packaging. The items should be tried on top of your underwear, hygienic protection stickers always in place. All items that do not comply with this procedure will not be returned.
Any product that has been damaged will not be refunded, taken back or exchanged; in which case, no refund will be made. The customer will remain the owner of the product and will then have the leisure to have it shipped back to him at his own expenses.
At any time the customer, during the ordering process, has the possibility to consult his purchase basket, the outstanding amount or to retract or to abandon the procedure before payment completion.

-by credit card for customers who have paid with the same method of payment
In case of a refund, the expenses of returns are at your charge.
In case of delivery mistakes or exchange, due to wrong information provided by the customer (wrong or incomplete delivery), the expenses of reshipment of the parcel will be at the sole charge of the customer.
From the moment the order has been validated and set, the address cannot be modified.
Delivery times are given as an indication, if it exceeds thirty days from the order, the contract may be terminated and the buyer refunded.
Article 9: CUSTOMS EXPENSES
Any order, which country (or region) of delivery is outside Belgium, placed on site, may be subject to customs duties. These custom duties are imposed by the country's current rules and regulations. It is the customers’ full responsibility to ensure of his awareness. The seller is not obliged to verify and inform his customers of the applicable customs duties and taxes. The customer must ask the competent authorities of his country before placing his order. If the recipient refuses to pay the customs duties or taxes, any sums claimed and taxed to Lovedelles to recover this parcel will be deducted from the amount of the refund made to the customer.
Article 10: INTELLECTUAL PROPERTY
All texts, comments, books, illustrations and images reproduced on Lovedelles are reserved under copyright and intellectual property rights throughout the whole world. As such, and in accordance with the provisions of the Intellectual Property Code, only use is permitted for private use, subject to different or even more restrictive provisions of the intellectual property code. Any total or partial reproduction of the www.lovedelles.com site is strictly prohibited.
Article 11: LIABILITY
The liability of Lovedelles cannot be committed for all the inconvenient or damages inherent to the use of the Internet network, especially in case of a breakdown of the service, an external intrusion or computer viruses, or any act characterized as force majeure, in accordance with the Belgian jurisprudence.
Article 12: MODIFICATION OF TERMS & CONDITIONS OF SALE
The seller reserves the right to adapt or modify at any time the present general conditions of sale. In case of modification, the general conditions of sale in force will be applied to each order, on the day of order.
Article 13: PRODUCT WARRANTY
With regards to the consumer, the seller guarantees the products he sells (law of 1 September 2004). In the event of non-conformity of the sold product registered within two months of delivery, the customer must notify the seller as soon as possible. This warranty only covers the defects of conformity existing at the time of delivery of the goods. Defects or damage due to misuse, poor maintenance, wear or negligence will lead to the guarantee cancellation.
If you receive a defective item in your order, please send us an e-mail containing your order number to notify us of the problem.
We will then do our upmost to return the parcel to you or refund the item.
However, the materials used in the manufacture of seaside articles may be altered by factors such as chlorine, water and sea salts, sunlight, sand. In case of claim due to one of these factors, the seller will not be held responsible for the non respect of the maintenance terms of the items and therefore no refund will be authorized.
Article 14: RIGHTS OF USE
The use of the brands displayed on the website is strictly forbidden.
ARTICLE 15: PROOF
The Parties shall accept electronic means of proof in their exchange.
Article 16: INTELLECTUAL PROPERTY
All the elements of the site owner are and remain the exclusive intellectual property of the one.
No one shall reproduce, exploit, re-broadcast or use any similar or identical title whatsoever, even partially.
Any simple or hypertext link is strictly forbidden without prior written agreement with the seller.
ARTICLE 17: SETTLEMENT OF DISPUTES
The present conditions are subject to the Belgian law.
In case of dispute, only the courts of the sellers’ head office are competent.

This information may be used to disseminate information related to the commercial activities of the seller to his customers by means of communication.
The seller retains the personal data in order to facilitate subsequent orders. The seller further agrees not to divulge the information available to another company.
